1. Acceptance of Terms

By accessing or using BookAgenda ("the Service"), operated by BookAgenda ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BookAgenda is a cloud-based scheduling and payment platform that allows service professionals ("Professionals") to manage bookings, clients, and payments. End-users ("Clients") can book appointments and purchase packages through Professional profiles.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. Professional Obligations

Professionals are responsible for: (a) the accuracy of their service listings, pricing, and availability; (b) honoring confirmed bookings; (c) complying with all applicable laws and regulations in their jurisdiction; and (d) maintaining any required professional licenses or certifications.

5. Payments and Fees

Payments are processed through our third-party payment provider. BookAgenda facilitates transactions but does not hold client funds. A transaction fee applies to each payment as specified in your plan. Subscription fees for paid plans are billed monthly and are non-refundable except as required by law.

6. Cancellations and Refunds

Cancellation policies are set by individual Professionals. BookAgenda is not responsible for disputes between Professionals and Clients regarding cancellations or refunds. Professionals should clearly communicate their cancellation policy to Clients.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) impersonate another person or entity; (c) interfere with or disrupt the Service; (d) attempt to gain unauthorized access to any part of the Service; or (e) use the Service to send spam or unsolicited communications.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by BookAgenda and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the Service.

9. Limitation of Liability

To the maximum extent permitted by law, BookAgenda shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Termination

We may terminate or suspend your account at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination by contacting support.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
